These Terms of Service ("Terms") govern your access to and use of BringAgent.com, BringAgent mobile applications, websites, software, services, communications, and related products (collectively, the "Platform").
The Platform is owned and operated by Cozy Dream Homes LLC ("Company," "BringAgent," "we," "our," or "us").
BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.
ELIGIBILITY
You must be at least eighteen (18) years old and capable of entering legally binding contracts.
If you use the Platform on behalf of a brokerage, company, team, or other entity, you represent that you have authority to bind that entity to these Terms.
PLATFORM PURPOSE
BringAgent is a networking, referral, marketing, collaboration, communication, and lead-management platform designed primarily for real estate professionals.
BringAgent:
• Is not a real estate broker
• Is not an escrow company
• Is not a title company
• Is not a lender
• Is not a law firm
• Is not a financial advisor
• Does not guarantee transactions
• Does not guarantee referrals
• Does not verify every user, license, lead, listing, vendor, or service provider
All communications, referrals, agreements, and transactions occur solely between users.
NO PROFESSIONAL ADVICE
Information provided through the Platform, including AI-generated content, reports, estimates, recommendations, forms, communications, and summaries, is provided for informational purposes only.
Nothing on the Platform constitutes:
• Legal advice
• Tax advice
• Accounting advice
• Financial advice
• Brokerage supervision
• Compliance guidance
Users should consult qualified professionals before making decisions.
ACCOUNT REGISTRATION
Users may be required to create an account.
You agree to:
• Provide accurate information
• Maintain current information
• Protect account credentials
• Notify us of unauthorized access
You are responsible for all activity occurring under your account.
REAL ESTATE COMPLIANCE
Users are solely responsible for compliance with:
• California Department of Real Estate regulations
• RESPA
• Fair Housing laws
• MLS rules
• REALTOR® association rules
• State licensing requirements
• Federal and state advertising laws
• Local regulations
BringAgent does not supervise licensees.
Users should consult their broker regarding brokerage policies.
REFERRALS AND COMMISSIONS
BringAgent may facilitate introductions or referral opportunities.
BringAgent:
• Does not guarantee referral quality
• Does not guarantee referral compensation
• Does not participate in brokerage activities
• Does not collect commissions unless separately disclosed
Users are solely responsible for compliance with all referral laws and brokerage requirements.
USER CONTENT
Users may submit:
• Text
• Images
• Videos
• Documents
• Listings
• Marketing materials
• Contact information
You represent that you own or have rights to all content submitted.
You grant BringAgent a non-exclusive license to store, display, process, and transmit such content solely for operation of the Platform.
You retain ownership of your content.
DOCUMENT UPLOAD POLICY
Users may upload documents only if legally authorized.
Prohibited uploads include:
• Copyrighted materials without authorization
• Proprietary forms without rights
• Stolen documents
• Fraudulent documents
• Malware
• Viruses
The Platform may remove content without notice.
AI SERVICES
The Platform may use artificial intelligence technologies.
AI-generated outputs may contain inaccuracies.
Users must independently verify all information before relying upon it.
AI outputs are provided "AS IS."
ACCEPTABLE USE
Users may not:
• Violate laws
• Spam recipients
• Send misleading communications
• Harass others
• Upload malicious code
• Scrape data
• Reverse engineer the Platform
• Impersonate others
• Circumvent security measures
Violation may result in immediate suspension.
COMMUNICATION SERVICES
The Platform may provide:
• Email services
• SMS messaging
• Notifications
• Marketing tools
• CRM functionality
• Automated campaigns
Users are responsible for lawful use of all communication tools.
SMS CONSENT
By providing a mobile phone number, you consent to receive SMS and MMS messages from BringAgent and Cozy Dream Homes LLC.
Messages may include:
• Account notifications
• Lead notifications
• Appointment reminders
• Marketing communications
• Service announcements
• Customer support messages
Consent is not a condition of purchase.
MESSAGE FREQUENCY
Message frequency varies based upon account activity, communication preferences, and Platform usage.
MESSAGE AND DATA RATES
Message and data rates may apply according to your mobile carrier plan.

Wireless carriers are not responsible for delayed or undelivered messages.
USER COMMUNICATION COMPLIANCE
Users utilizing communication tools agree to comply with:

• California Consumer Privacy Act
• Federal Trade Commission regulations
• State telemarketing laws
• Do-Not-Call regulations
Users are solely responsible for obtaining required consent before contacting third parties.
PROHIBITED COMMUNICATIONS
Users may not use the Platform to:
• Send spam
• Send deceptive messages
• Violate Do-Not-Call laws
• Send unlawful solicitations
• Harass recipients
• Send messages without required consent
MOBILE PRIVACY
Mobile phone numbers, SMS consent records, and opt-in data will not be sold, rented, shared, transferred, or disclosed to third parties for their own marketing purposes.
PRIVACY POLICY
Your use of the Platform is also governed by the Privacy Policy, which is incorporated into these Terms by reference.
SUBSCRIPTIONS AND FEES
Certain features may require payment.
Prices may change at any time.
Unless required by law, fees are non-refundable.
BETA SERVICES
Certain features may be offered in beta form.
Beta features may:
• Contain bugs
• Be unavailable
• Lose data
• Change without notice
Use beta services at your own risk.
THIRD-PARTY SERVICES
The Platform may integrate with:
• Twilio
• SendGrid
• Google
• Firebase
• MLS systems
• Mapping providers
• Other third-party services
We are not responsible for third-party services.
INTELLECTUAL PROPERTY
All Platform software, designs, trademarks, logos, source code, databases, and content belong to Cozy Dream Homes LLC or its licensors.
No rights are granted except those expressly provided herein.
DISCLAIMER OF WARRANTIES
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:
• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• AVAILABILITY
WE DO NOT GUARANTEE ERROR-FREE OPERATION.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
COZY DREAM HOMES LLC, BRINGAGENT, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
THIS INCLUDES:
• LOST PROFITS
• LOST COMMISSIONS
• LOST DATA
• LOST BUSINESS OPPORTUNITIES
• REPUTATIONAL DAMAGE
TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF:
(A) $100 USD; OR
(B) THE AMOUNT PAID BY THE USER TO THE PLATFORM DURING THE TWELVE MONTHS PRECEDING THE CLAIM.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Cozy Dream Homes LLC and its affiliates from claims, damages, costs, liabilities, and attorney fees arising from:
• Your use of the Platform
• Your communications
• Your uploaded content
• Your legal violations
• Your business activities
TERMINATION
We may suspend or terminate accounts at any time for any reason.
Users may stop using the Platform at any time.
GOVERNING LAW
These Terms shall be governed by the laws of the State of California.
ARBITRATION
Any dispute shall be resolved through binding arbitration in Orange County, California under the rules of the American Arbitration Association.
Users waive:
• Jury trials
• Class actions
• Representative actions
FORCE MAJEURE
We are not liable for delays or failures caused by events beyond our reasonable control, including:
• Natural disasters
• Power outages
• Internet outages
• Government actions
• Cyberattacks
ENTIRE AGREEMENT
These Terms constitute the entire agreement between the parties.
SEVERABILITY
If any provision is found unenforceable, the remaining provisions remain in effect.
CHANGES TO TERMS
We may update these Terms at any time.
Continued use of the Platform constitutes acceptance of revised Terms.
